Indemnification and Hold Harmless Agreement
1. I, hereby acknowledge that, in the course of my use of property owned by the Nabnasset Improvement Association, namely the Canoe and Kayak Rack located at the Mary Lou Beach, I shall operate at my own risk and without regard to any defect or unsafe condition of said property or any negligence or absence of due care on the part of the Nabnasset Improvement Association.

2. In consideration of my use of the Canoe and Kayak Rack, I hereby agree, for myself and my spouse, heirs, representatives, executors, administrators, assigns and agents, and do hereby jointly and severally, release and forever discharge the Nabnasset Improvement Association, its agents, servants and employees (hereinafter collectively referred to as the “NIA”) from any cause of action, claim or demand of any nature whatsoever including, but not limited to, a claim of negligence that I or my spouse, heirs, representatives, executors, administrators, assigns or agents may now have or have in the future against the NIA on account of damage to or loss of property, personal injury, bodily injury, death or accident of any kind, arising out of or in any way related to my use of the Canoe and Kayak Rack.

3. I further agree to defend, indemnify and hold harmless the NIA from and against any claims of any nature whatsoever and for the cost and expense including, but not limited to, attorney fees and legal costs arising out of any claim in connection with its use of the Canoe and Kayak Rack.

4. I hereby certify that I have full knowledge of the nature and extent of risks inherent in my use of the Canoe and Kayak Rack. I understand that I will be solely responsible for any loss or damage, including death, that I sustain or cause, to myself, my property, the Canoe and Kayak Rack or any other person or relieving the NIA of any and all liability for such loss or damage.

5. I further agree that, in consideration of my use of the Canoe and Kayak Rack, any Lock used to secure my property will be cut and I will be charged a $50 delivery fee for any property I store at the Canoe and Kayak Rack if I fail to remove said property from the Canoe and Kayak Rack by November 1 of each year. In the event that such property is abandoned, I agree that the NIA has the right to remove the abandoned property and I agree to pay a $50 delivery fee. I understand that it is my responsibility to remove any property I have stored at the Canoe and Kayak Rack by November 1, and the NIA has no duty to remind me to do so. Therefore, failure to remind me to remove my property by November 1 shall in no way invalidate the terms of the Agreement.

6. My agreement to this document indicates that I have read this agreement, which shall take effect as a sealed instrument. I further certify that I am 18 years or older and that I am otherwise legally competent to sign this agreement. I further understand that the terms of this agreement are legally binding and I have carefully read and understood the same, of my own free will.

Rules and Regulations
1. The canoe/kayak racks are for use only by Nabnasset Improvement Association Members.

2. Only one (1) rental slot per family/household is permitted.

3. Only 1 canoe, 1 two-person kayak, 1 single-person kayak, or 2 paddle boards allowed per slot. Maximum weight 50lbs per slot.

4. Permits will be issued to Nabnasset Improvement Association members whose application is received by July 15, 2024  based on a random selection until all available spaces are assigned.

5. Permits must be affixed and visibly displayed on each paddlecraft stored on the rack.

6. No paddlecrafts, sails, poles, or paddles are permitted to be stored on the ground at the NIA Beach. Any  equipment not stored on the kayak racks will be removed and result in forfeiture of the slot.

7. All paddlecrafts must remain at the beach for the season and may not be used in other lakes. This is to prevent the spread of invasive species such as zebra mussels into Nabnasset Pond.

8. Nabnasset Improvement Association will inspect the kayak racks regularly to ensure compliance with these rules. Any violation of the rules will result in the removal of the paddlecraft and forfeiture of the slot.

9. All paddlecrafts must be removed by November 1. If the paddlecraft is not removed it will be removed and delivered to the residence on file and a $50 removal fee will be charged before your membership can be renewed for the following season.  Nabnasset Improvement Association reserves the right to have you remove the paddlecrafts prior to that date  for any reason, including but not limited to beach closures.

10. Violating any of these rules may result in the forfeiture of the slot for the season and possibly future seasons. If there are any questions or to receive additional information, please contact the Nabnasset Improvement Association and niawestford@gmail.com
